Football tipping competitions

Includes other minor fundraising activities.

Section 108 of the Gaming and Wagering Commission Act 1987 (the Act) and Regulations 40 and 40A of the Gaming and Wagering Commission Regulations 1988 (the Regulations) provide for the conduct of minor fundraising activities without the need for a permit.

Football tipping competitions are considered to be minor fundraising activities. A person may conduct a football tipping competition, provided the aggregate of the prizes offered for the football season to which the competition relates, does not exceed $10,000.

The relevant provisions of the Act and Regulations are:

108. Minor fund raising activities (Gaming and Wagering Commission Act 1987)

  1. The conduct of:
    1. a guessing competition or any other competition in which success does not depend to a substantial degree on the exercise of skill;
    2. a number game based on sporting achievements of a public nature; or
    3. a raffle, chocolate wheel, art union or other scheme or device for the disposition of property; or
    4. any other minor fund raising activity,
    5. which would otherwise be taken to constitute gaming, betting, or a lottery, when conducted as a means of raising money for the benefit of community, cultural, ethnic or charitable purposes, and not for the purposes of private gain or any commercial undertaking, shall, subject to subsection (2) and unless subsection (3) applies, not be taken to be unlawful and shall be deemed to be conducting a permitted amusement with prizes.
  2. The aggregate value of the prizes offered or distributed in relation to an activity to which this section relates shall not exceed the prescribed amount.
  3. The Commission may, by notice in writing to the person proposing to conduct or conducting gaming or betting of a kind to which subsection (1) refers, prohibit the conduct of that gaming or betting, or gaming or betting of that kind in the circumstances specified in the notice.
  4. A person who contravenes a prohibition imposed pursuant to subsection (3) commits an offence. Penalty: $2000.

40. Minor fund raising activities (Gaming and Wagering Commission Regulations 1988)

Subject to regulation 40A, for the purposes of section 108, the aggregate value of prizes shall not exceed $200.

40A. Football tipping (section 108) (Gaming and Wagering Commission Regulations 1988)

Despite regulation 40, if a person is conducting a football tipping competition under section 108, the aggregate of the prizes offered for the football season to which the competition relates may exceed $200, but shall not exceed $10,000.
