Appeal allowed, penalty varied


Disqualification for 5 years under Rule 175(a) for use of a battery. Appeal as to penalty only. Appeal dismissed. Three penalties each of 5 years disqualification for presenting a horse for racing which has had a prohibited substance administered (Etorphine) to it under Rule 178. Appeal as to penalty only. Appeal upheld, penalties varied to three periods of disqualification each of 2 years. All periods of disqualification to be served cumulatively.

I accept the submission of Counsel for the respondent that on race days horses should be supervised more closely than on days when? evidence establishes that he was careless or indifferent in relation to the two horses in question.
