Section 175 liquor restrictions

Section 175 restrictions are declared by the Governor of Western Australia on the recommendation of the Minister for Racing and Gaming.

These restrictions:

  • apply to a declared area of the State;
  • may prohibit the bringing in, possession and consumption of liquor in the declared area; and
    may provide for penalties to apply to people who contravene the restrictions.

While enjoying the many attractions Western Australia has to offer, be aware that restrictions are in place in many parts of the State in relation to purchasing, consuming or possessing alcohol.

These restrictions have been implemented as a way of minimising alcohol-related harm in Western Australia.
The Liquor Control Act 1988 provides for the following types of restrictions.

Bayulu (Section 175)

Current restrictions

The Liquor Control (Bayulu Restricted Area) Regulations 2013 prohibit a person from bringing into and possessing liquor in the restricted area. Where a person commits an offence against the regulations, the penalties to apply are:

  • where the person is a licensee, manager of a licensed premises or a director of a body corporate holding a licence, a fine of $5000; or
  • in any other case, a fine of $2000.

The regulations also authorise the police to seize and dispose of opened or unopened containers of liquor suspected of being brought into the restricted area.

The Liquor Control (Bayulu Restricted Area) Regulations 2013 are due to expire on 28 June 2027.

Bungardi (Section 175)

Region: Goldfields

Expires 19 August 2025

The Liquor Control (Bungardi Restricted Area) Regulations 2017 prohibit a person from bringing into and possessing liquor in the restricted area. Where a person commits an offence against the regulations, the penalties to apply are:

  • where the person is a licensee, manager of a licensed premises or a director of a body corporate holding a licence a fine of $5000; or
  • in any other case, a fine of $2000

The regulations also authorise the police to seize and dispose of opened and unopened containers of liquor suspected of being brought into the restricted area.

The Liquor Control (Bungardi Restricted Area) Regulations 2017 are due to expire on 19 August 2025.

Cheeditha (Section 175)

The Liquor Control (Cheeditha Restricted Area) Regulations 2012 prohibit a person from bringing into and possessing liquor in the restricted area. Where a person commits an offence against the regulations, the penalties to apply are:

  • where the person is a licensee, manager of a licensed premises or a director of a body corporate holding a licence a fine of $5000; or
  • in any other case, a fine of $2000

The regulations also authorise the police to seize and dispose of opened and unopened containers of liquor suspected of being brought into the restricted area.

The Liquor Control (Cheeditha Restricted Area) Regulations 2012 are due to expire on 10 August 2026.

Irrungadji (Section 175)

The Liquor Control (Irrungadji Restricted Area) Regulations 2010 prohibit a person from bringing into and possessing liquor in the restricted area. Where a person commits an offence against the regulations, the penalties to apply are:

  • where the person is a licensee, manager of a licensed premises or a director of a body corporate holding a licence a fine of $5000; or
  • in any other case, a fine of $2000

The regulations also authorise the police to seize and dispose of opened and unopened containers of liquor suspected of being brought into the restricted area.

The Liquor Control (Irrungadji Restricted Area) Regulations 2010 are due to expire on 4 December 2028.

Jarlmadangah Burru (Section 175)

  • in any other case, a fine of $2000.

The regulations also authorise the police to seize and dispose of opened and unopened containers of liquor suspected of being brought into the restricted area.

The Liquor Control (Jarlmadangah Burru Restricted Area) Regulations 2019 are due to expire on 13 December 2028.

Jigalong (Section 175)

The Liquor Control (Jigalong Restricted Area) Regulations 2009 prohibit a person from bringing into and possessing liquor in the restricted area. Where a person commits an offence against the regulations, the penalties to apply are:

  • where the person is a licensee, manger of a licensed premises or a director of a body corporate holding a licence, a fine of $5000; or
  • in any other case, a fine of $2000.

The regulations also authorise the police to seize and dispose of opened or unopened containers of liquor suspected of being brought into the restricted area illegally.

The Liquor Control (Jigalong Restricted Area) Regulations 2009 are due to expire on 1 May 2034.

  • in any other case, a fine of $2000.

The regulations also authorise the police to seize and dispose of opened or unopened containers of liquor suspected of being brought into the restricted area illegally.

The Liquor Control (Juwurlinji Restricted Area) Regulations 2009 are due to expire on 24 July 2028.

Kadjina (Section 175)

The Liquor Control (Kadjina Restricted Area) Regulations 2020 prohibit a person from bringing into and possessing liquor in the restricted area. Where a person commits an offence against the regulations, the penalties to apply are:

  • where the person is a licensee, manager of a licensed premises or a director of a body corporate holding a licence, a fine of $5000; or
  • in any other case, a fine of $2000.

The regulations also authorise the police to seize and dispose of opened and unopened containers of liquor suspected of being brought into the restricted area.

The restricted area is defined as:

a) the area of land described as Lot 9 on Deposited Plan 238001 and the subject of Certificate of Title LR3011/45; and

b) the area of land described as Lot 60 on Deposited Plan 238001 and the subject of Certificate of Title LR3011/50.

The Liquor Control (Kadjina Restricted Area) Regulations 2020 are due to expire on 10 October 2025.

Kalumburu (Section 175)

Region: Kimberley

Current restrictions

The Liquor Control (Kalumburu Restricted Area) Regulations 2018 prohibit a person from bringing into and possessing liquor in the restricted area (unless an exception under r. 9 of the Liquor Control (Kalumburu Restricted Area) Regulations 2018 applies). Where a person commits an offence against the regulations, the penalties to apply are:

  • where the person is a licensee, manager of a licensed premises or a director of a body corporate holding a licence, a fine of $5000; or
  • in any other case, a fine of $2000

The regulations also authorise the police to seize and dispose of opened or unopened containers of liquor suspected of being brought into the restricted area.

Definitions

The Liquor Control (Kalumburu Restricted Area) Regulations 2018 define:

the Kalumburu Community as the area of land within a radius of 20 km of the point with the following Geocentric Datum of Australia 2020 (GDA2020) coordinates:

  1. 14.295430°S;
  2. 126.642314°E; and

McGowan Island camping grounds as the area of land within a radius of 500 m of the point with the following GDA94 coordinates:

  1. 14.1460647°S;
  2. 126.649881°E.

Kunawarritji (Section 175)

Region: Pilbara

Expires 3 May 2025

The Liquor Control (Kunawarritji Restricted Area) Regulations 2011 prohibit a person from bringing into and possessing liquor in the restricted area. Where a person commits an offence against the regulations, the penalties to apply are:

  • where the person is a licensee, manager of a licensed premises or a director of a body corporate holding a licence a fine of $5000; or
  • in any other case, a fine of $2000

The regulations also authorise the police to seize and dispose of opened and unopened containers of liquor suspected of being brought into the restricted area.

A person does not commit an offence in relation to the possession of the alcohol within the Kunawarritji Community if the person:

  1. is a tourist; and
  2. does not consume the liquor in his or her possession; and
  3. continuously maintains possession of the liquor until such time as he or she has left the Kunawarritji Aboriginal Community.

Tourists using Well 33 camping grounds may possess and consume alcohol while on the Grounds and they do not commit an offence under the regulations.

Kundat Djaru (Section 175)

The Liquor Control (Kundat Djaru Restricted Area) Regulations 2010 prohibit a person from bringing into and possessing liquor in the restricted area. Where a person commits an offence against the regulations, the penalties to apply are:

  • Where the person is a licensee, manager of a licensed premises or a director of a body corporate holding a licence, a fine of up to $5000; or
  • in any other case, a fine of $2000.

The regulations also authorise the police to seize and dispose of opened and unopened containers of liquor suspected of being brought into the restricted area.

The Liquor Control (Kundat Djaru Restricted Area) Regulations 2010 are due to expire on 18 September 2025.

Looma (Section 175)

Region: Kimberley

The Liquor Control (Looma Restricted Area) Regulations 2011 prohibit a person, other than an exempt person, from bringing into and possessing liquor in the restricted area. Where a person commits an offence against the regulations, the penalties to apply are:

  • where the person is a licensee, manager of a licensed premises or a director of a body corporate holding a licence a fine of $5000; or
  • in any other case, a fine of $2000.

The regulations also authorise the police to seize and dispose of opened and unopened containers of liquor suspected of being brought into the restricted area.

A person does not commit an offence in relation to the possession of the alcohol within the Looma Aboriginal Community if the person is an exempt person.

In this regulation:

  • an exempt person means the driver of or a passenger in a transiting vehicle
  • transiting vehicle means a vehicle that transits the Looma Aboriginal Community on a public road without:
    1. stopping; or
    2. discharging any person or item.

Parnngurr (Section 175)

Region: Pilbara

Expires 7 January 2035

The Liquor Control (Parnngurr Restricted Area) Regulations 2018 prohibit a person from bringing into and possessing liquor in the restricted area. Where a person commits an offence against the regulations, the penalties to apply are:

  • where the person is a licensee, manager of a licensed premises or a director of a body corporate holding a licence, a fine of $5000; or
  • in any other case, a fine of $2000.

The regulations also authorise the police to seize and dispose of opened or unopened containers of liquor suspected of being brought into the restricted area.

A person does not commit an offence in relation to the possession of the alcohol with the Parnngurr Community if the person – .

  1. is an exempt person (a tourist); and
  2. does not consume the liquor in his or her possession.
  3. continuously maintains possession of the liquor until such time as he or she has left the Parnngurr Aboriginal Community.

Parnpajinya (Section 175)

The Liquor Control (Parnpajinya Restricted Area) Regulations 2020 prohibit a person from bringing into and possessing liquor in the restricted area. When a person commits an offence against the regulations, the penalties to apply are:

  • where the person is a licensee or manager of a licensed premises , or a director of a body corporate holding a licence, a fine of $5000; or
  • in any other case, a fine of $2000. 

The regulations also authorise the police to seize and dispose of opened and unopened containers of liquor suspected of being brought into the restricted area.

The restricted area is defined as:

a) the area of land described as Reserve 42835 being Lot 228 on Deposited Plan 038162 and being the whole of the land in Record of Qualified Certificate of Crown Land Title Volume LR3133 Folio 736; and

b) the land that is within 100 metres of the outer boundary of the area of land described in paragraph (a).

Punmu (Section 175)

Spinifex (Section 175)

Region: Goldfields

Expires 2 July 2034

The Liquor Control (Spinifex Restricted Area) Regulations 2014 prohibit a person from bringing into and possessing liquor in the Restricted Area. Where a person commits an offence against the regulations, the penalties to apply are:

  • where the person is a licensee, manager of a licensed premises, or a director of a body corporate holding a licence, a fine of $5000; or
  • in any other case, a fine of $2000.

The regulations also authorize the police to seize and dispose of opened and unopened containers of liquor suspected of being brought into the Restricted Area.

A person does not commit an offence under the regulations in relation to the possession/consumption of alcohol within the Spinifex Native Title Determination area excluding the portion which lies within Reserve 17614, if the person:

  1. is a tourist; and does not consume the liquor in his or her possession; and continuously maintains possession of the liquor until such time as he or she has left the Restricted Area.
  2. is a tourist in the portions of the Restricted Area that are within 50 metres either side of the Anne Beadell Highway (also known as the Serpentine Lakes Road), and continuously maintains possession of, or consumes, the liquor in his or her possession.

Strelley (Section 175)

The Liquor Control (Strelley Restricted Area) Regulations 2024 prohibit a person from bringing into and possessing liquor in the restricted area. Where a person commits an offence against the regulations, the penalties to apply are:

  • where the person is a licensee, manager of a licensed premises or a director of a body corporate holding a licence a fine of $5000; or
  • in any other case, a fine of $2000.

The regulations also authorise the police to seize and dispose of opened and unopened containers of liquor suspected of being brought into the restricted area.

A person does not commit an offence in relation to the possession of the alcohol within the Strelley Aboriginal Community if the person is an exempt person.

In this regulation:

  • an exempt person means the driver of or a passenger in a transiting vehicle
  • transiting vehicle means a vehicle that transits the Strelley Aboriginal Community on a public road without:
    1. stopping; or
    2. discharging any person or item.

The Liquor Control (Wakathuni Restricted Area) Regulations 2019 prohibit a person, other than an exempt person, from bringing into and possessing liquor in the restricted area. Where a person commits an offence against the regulations, the penalties to apply are:

  • where the person is a licensee, manager of a licensed premises or a director of a body corporate holding a licence, a fine of $5000; or
  • in any other case, a fine of $2000.

The regulations also authorise the police to seize and dispose of opened and unopened containers of liquor suspected of being brought into the restricted area.

A person does not commit an offence in relation to the possession of alcohol within the Wakathuni community if the person is an exempt person.

An exempt person means: the driver of or a passenger in a transiting vehicle.

A transiting vehicle means a vehicle that transits the Wakathuni community on a public road without stopping or discharging any person or item.

Wangkatjungka (Section 175)

  • in any other case, a fine of $2000.

The regulations also authorise the police to seize and dispose of opened or unopened containers of liquor suspected of being brought into the restricted area illegally.

Warralong (Section 175)

Region: Pilbara

The Liquor Control (Warralong Restricted Area) Regulations 2013 prohibit a person from bringing into and possessing liquor in the restricted area. Where a person commits an offence against the regulations, the penalties to apply are:

  • where the person is a licensee, manager of a licensed premises or a director of a body corporate holding a licence, a fine of $5000; or
  • in any other case, a fine of $2000.

The regulations also authorise the police to seize and dispose of opened or unopened containers of liquor suspected of being brought into the restricted area illegally.

The Liquor Control (Warralong Restricted Area) Regulations 2013 define the Warralong Aboriginal Community as:

(a) the land lying within a circle of 20 kilometres radius measured from the centre of the Warralong basketball court located at the point with the following Geocentric Datum of Australia 2020 (GDA 2020) coordinates -

Weymul (Section 175)

The Liquor Control (Weymul Restricted Area) Regulations 2024 prohibit a person from bringing into and possessing liquor in the restricted area. Where a person commits an offence against the regulations, the penalties to apply are:

  • where the person is a licensee, manager of a licensed premises or a director of a body corporate holding a licence a fine of $5000; or
  • in any other case, a fine of $2000.

The regulations also authorise the police to seize and dispose of opened and unopened containers of liquor suspected of being brought into the restricted area.

The Liquor Control (Weymul Restricted Area) Regulations 2024 are due to expire on 19 March 2029.
